  2. Delos Living LLC (“Delos,” “we,” “us,” or “our”) is committed to protecting your privacy. To demonstrate this commitment, we have adopted this privacy policy (this “Policy”) which applies to the MindBreaks™ application, including any online, mobile and tablet applications used to access the MindBreaks service (collectively, the “Services” or “MindBreaks”). This Policy does not apply to: (i) information we collect from our public websites; (ii) any Delos products or services that refer to or link to a different privacy policy or statement; or (iii) those Delos subsidiaries and affiliates that have published their own privacy policy or statement.

    The Policy is designed to help you understand generally how we collect, use and disclose information about you in connection with your Services. Your use of the Services is subject to this Policy and our Terms of Use; by accessing the Services you acknowledge and agree to accept this Policy.

  3. TYPES OF INFORMATION WE COLLECT AND WHY WE COLLECT IT
  4. We may collect personally identifiable information if you choose to submit it to us, or non-personally identifiable information through your use of the Services. Personally identifiable information (or personal information) is information that personally identifies you such as your name and email address, and non-personally identifiable information is information that does not personally identify you, including anonymous information and aggregated data about how users use the Services. Information is collected in order to provide the Services to you and improve our Services and offerings and for other general or research related purposes. Information can be collected if you submit it to us or it may be collected automatically through technology.

    2. You may be asked to submit your name and email address when you register in order to verify user credentials. Further, you may provide feedback or respond to surveys about your use of the Services.

    3. Usage and Non-identifiable Information
    4. We may collect non-identifiable information about how you use the Services, such as the specific content you listen to, view or access and the frequency of such use. We use such information to provide, maintain and improve the Services and gather other relevant statistics and information. If you are using the Service as an employee or member of an organization, we may also share aggregated usage information with such organization. We may also share aggregated usage data with users of the Service, such as to provide recommended content or showcase popular content

    5. Information collected by technology
    6. The Services use Microsoft App center analytics and Apple App Store Connect analytics to collect and track the following information and provide us with certain analytics: (1) time spent using the Services; (2) device model, operating system and other device identifiers; (3) country if the Services are being accessed from an iPad with a sim card; or (4) error details in the event of a Service failure.

  5. WHO HAS ACCESS TO YOUR INFORMATION?
  6. We may share information about you in the following cases and as otherwise described in this Policy:

    1. We may disclose information to our affiliates and subsidiaries.

We may also disclosure information to third party service providers we engage to perform functions on our behalf, including to help us to operate and deliver the Services, such as technology and other consultants, attorneys, accountants, or website or database hosting companies. These service providers will have access to your information to the extent necessary and solely for the purpose of performing services on our behalf.

We may also disclose your information if legally required to do so, if requested to do so by a government entity, or if we believe in good faith that such action is necessary to conform to legal requirements or comply with legal process, protect the rights or property of Delos, prevent a crime, or protect the integrity of the Services and personal safety of our users or the public.

We may also disclose and transfer your information to a third party who acquires any or all of our assets, whether by way of acquisition, merger, consolidation, or purchase of all or a substantial portion of our assets. In addition, in the event Delos becomes the subject of an insolvency proceeding, whether voluntary or involuntary, Delos or its liquidator, administrator, receiver or administrative receiver may sell, license, or otherwise dispose of such information in a transaction approved by the court.

We may share non-personal (such as aggregated or anonymized) information collected from you in connection with your use of the Service, to other users or potential users of the Services, to our affiliates and other companies with whom we conduct business and to the general public, such as for research or marketing or promotional purposes or for purposes of improving and developing the Services.

    Delos does not sell the personal information it collects through the Services to data brokers, aggregators or other similar third parties for compensation.

If you wish to view, change or remove any of personal information collected by us in connection with your use of the Services, if any, or if you wish to change your preferences regarding communications, you can contact us using the contact details provided under the “Contacting Us” section below.

  10. The security of your information is important to us, and we endeavor to protect your personal information. However, there is no such thing as perfect security on the Internet, and you provide personal information to us at your own risk. Delos expressly disclaims, to the extent permitted under law, all liability for any damages, losses or claims of any kind relating to any personal information that you provide to us or others through the Services. When you use any Services, we encourage you to protect your information and use precautions including but not limited to using strong passwords, and not sharing your password and account information with any other person.

  11. THIRD PARTY APPLICATIONS
  12. The Services may contain links to or may link from third party applications or websites. We cannot be and are not responsible for the privacy practices of any third-party applications or websites. If you provide any information to parties who operate third party applications or websites that are linked to or from the Services, use or disclosure of your personal information will be governed by those third parties’ policies. We encourage you to review each third parties’ policies and privacy practices before revealing personal information. Under no circumstances shall Delos have any liability whatsoever for the activities conducted by or at any third-party application or website accessed from or through the Services.

  13. INFORMATION REGARDING CHILDREN
  14. This Services are not directed to children (persons under 13 years of age), and Delos does not knowingly collect any personal information from children.

  15. ONLINE TRACKING
  16. We do not track users of the Services over time and across third party websites to provide targeted advertising, and therefore do not respond to Do Not Track (“DNT”) signals.

  17. YOUR CALIFORNIA PRIVACY RIGHTS
  18. California residents are entitled under California state law to request access to and correct personal information we maintain about you, to request the restriction of processing of your personal information or to request erasure of your personal information in certain circumstances. In addition, California residents are entitled under California state law to request from us once per year information regarding disclosure of your personal information, if any, by Delos Living LLC or its subsidiaries to a third party for that third party’s direct marketing purposes.   19. INTERNATIONAL USE

This Policy is intended to meet the laws and regulations of the United States, and despite the global nature of the Internet, Delos makes no claims that the Services are appropriate or may be viewed or used outside the United States. By sending us your data via the Services, you consent to its transfer to and storage within the United States. Those who access the Services from outside the United States do so on their own initiative and are responsible for compliance with local laws, rules and regulations.

  21. CHANGES TO OUR PRIVACY POLICY
  22. We may amend this Policy at any time, so we encourage to consult with this Policy periodically. If we update this Policy, we will post the updated Policy on our website and/or within an applicable device. Any such changes will be effective upon posting.
